Senate Democrats have stated that:

- the burden of proof is on the accused
- there is no presumption of innocence
- innocent people demand FBI investigations of their own behavior if they are accused of wrongdoing

They must call for an FBI investigation into themselves!
Democrats like @ChuckSchumer say there is NO EVIDENCE that Senate Democrats colluded to smear Brett Kavanaugh.

They should welcome an FBI investigation then! After all, if they are innocent, they have nothing to hide!

If that's true, he should be demanding an FBI investigation into Senate Democrats - and himself, as well!

From now on, ANY time a Democrat is accused of any kind of wrongdoing, and protests their innocence, they should IMMEDIATELY be asked why they are not demanding an FBI investigation into their own behavior.

First, I agree with French that the President does not have inherent, unilateral authority - as a constitutional matter - to build the wall.

That's the lesson of Youngstown (the Steel Seizure cases)

Trump must be able to point to statutory authority.
I also agree with French that 10 USC § 2808 doesn't provide the necessary authority, for the reasons French talks about. It would be very difficult to characterize the wall as a "military construction project."

First, 50 U.S.C. § 1621 gives the President the authority to declare a national emergency.

He must transmit the proclamation to Congress and publish it in the Federal Register.
50 U.S.C. § 1631 requires that the President specify the *other* statutes he intends to invoke to justify further actions.

We'll explore some of those other statutes in a few posts.
