#JohnKinsman of the #ProudBoys was arraigned in Manhattan Criminal Court late last night on charges of Attempted Gang Assault in the Second Degree (a felony) & various misdemeanor charges.

He is being held in jail on $25,000 bail.
The case was adjourned to this Thursday, October 25, in Part F, Manhattan Criminal Court, for grand jury action.

The prosecutor has until then to present the case to the grand jury and secure an indictment or Kinsman will be released from jail.
In the alternative, they could reduce the top count to a misdemeanor and Kinsman could be held in, but bail would be reduced.

Kinsman's lawyer, Ronald Hart, served notice that his client intended to testify in the grand jury, but this does not necessarily indicate he will.
Kinsman was described by prosecutors as the "single most vicious" of the #ProudBoys who perpetrated the violence of a week ago.

I do not know his criminal record.

I do know $25,000 bail is low for someone w/ no criminal record facing these charges in these circumstances.
I have practiced in Manhattan & Brooklyn. Bail tends to be set much higher in Manhattan. Sentences tend to be longer in Manhattan. It has a reputation, generally deserved, for being the harshest in the city.
Honestly w/ this sort of video evidence, w/ the person alleged to be the ringleader, being 39 years old not a child, an admitted member of a fascist organization (hello - the tattoo) I would expect bail of at least $100,000.
That bail is low compared to what would be set in the case of my clients and I am talking about when my clients are not the alleged ringleaders but kinda just standing around, but still charged w/ gang assault, which for some reason the other #ProudBoys arrested here weren't.

I need to correct this thread. The arraignment charges were Attempted Gang Assault in the First Degree and IN ADDITION a charge of Assault in the First Degree. The first charge is a B violent felony. The second a C violent felony.
This makes the bail amount set even more outrageous by comparison to like cases. The bail - $25,000 bond or $15,000 cash - was paid yesterday in the form of bond.
I am not sure whether Kinsman has a criminal record. For someone who has NO criminal record the mandatory minimum sentence on Assault in the First Degree is 5 years in prison. The maximum is 25. For Attempted Gang Assault in the First Degree the sentencing range is 3 1/2 to 15.
