Rosenstein is no longer overseeing the Mueller probe. Acting AG Matt Whitaker has control, per DOJ.
DOJ official says ethics officials have yet to examine whether Whitaker has to recuse on anything Mueller related given his prior commentary and role.

Whitaker can serve for a long time -- at least 210 days, pursuant to the Vacancies Reform Act, 5 U.S.C 3346. 2/
Whitaker could actually serve much longer -- if Trump has nominated someone else to be AG and that nomination is still pending on day 210, he can stay on. If the nomination fails, he gets another 210 days. And if a *second* nomination fails, he gets *another* 210 days! 3/

1998 Federal Vacancies Reform Act gives the president the authority to temporarily move a Senate-confirmed political appointees into a vacant position when the predecessor dies or resigns...In the case of firings, the federal govt has a succession plan.

I think I understand some of this succession stuff ... for the dummies like me out there: It only matter whether #Rosenstein was fired or resigned for his duties as deputy attorney general.
But he was overseeing the Mueller probe as the acting attorney general (because Sessions had to recuse).
Whoever replaces him as acting deputy attorney general (until Trump appoints someone new) cannot also perform the duties of acting attorney general. No "acting-acting" allowed.
