Trump & Trump Foundation’s motion to dismiss the civil lawsuit brought by New York State Attorney General Barbara Underwood has been denied by judge:
Judge has given the defendants – Donald Trump, his three eldest children and the Trump Foundation – 45 days to respond to the petition.
As in the Summer Zervos case, the judge has rejected the argument that a sitting president can’t face a civil lawsuit in state court for actions not taken in his official capacity:
Donald Trump has appealed the Zervos decision. That matter is still pending before the appeals court.
The New York state attorney general's civil lawsuit against the Donald J. Trump Foundation, President Donald Trump and his three eldest children can proceed after a state court judge on Friday denied their motion to dismiss the case.

NEW: Michael Cohen pleaded guilty this morning in Manhattan federal court to one count of false statements to Congress in connection with “the Moscow project.” Prosecutors were members of the special counsel’s team, including Jeannie Rhee & Andrew Goldstein.
“I made these statements to be consistent with Individual-1’s political messaging and to be loyal to Individual-1,” Cohen said in court.
After Cohen stated his allocution, a prosecutor stood up & added that Cohen had also “minimized his contacts with the Russian government” to Congress, and that in fact Cohen had had a 20-minute conversation with a spokesman for the Kremlin. Cohen acknowledged that was correct.

SDNY just filed its brief in opposition to an effort to have Michael Cohen search warrant materials unsealed.

In its court filing, SDNY acknowledges "a grand jury investigation into Michael Cohen and others, which remains ongoing."

"unsealing of the Materials at the present time would interfere with this investigation, and would implicate significant privacy concerns for numerous uncharged third parties who are named in the Materials."
SDNY has made a separate filing under seal that it says contains specifics about the ongoing grand jury and law enforcement investigations it references in today’s public filing.
