A sitting president cannot be indicted. Professional journalists should at least note this conclusion of DOJ and most scholars in stories about @realDonaldTrump and the plea by Michal Cohen. For some background: hughhewitt.com/yale-law-schoo…
The first person to consider this issue? Alexander Hamilton in Federalist 69: “The President of the United States would be liable to be impeached, tried, and, upon conviction of treason, bribery, or other high crimes or misdemeanors, removed from office; and would afterwards
be liable to prosecution and punishment in the ordinary course of law.” avalon.law.yale.edu/18th_century/f…. If a reporter or pundit despises @realDonaldTrump so much that they are just “forgetting” this basic assumption in their assessments/assertions of @POTUS to prosecution, they should
find a new line of work. I’m used to terrible Con Law takes on obscure areas but this isn’t a new understanding. It was widely understood at the time of the Clinton and Nixon impeachments. It is a disservice to public to fudge this because of TDS. The good journalists note it.
