UPDATE: In the Manafort case in DC, here's Mueller's office on whether testimony of any witnesses will be needed for the court to make determinations on whether Manafort breached his plea agreement. (tl;dr: They don't know yet, b/c Manafort's team hasn't yet responded.)
Manafort has to respond to Mueller's filing from earlier this week — the ~evidence~ filing — by 10a Wednesday. The hearing, as of now, is set for 9:30a Friday.

JUST IN: DOJ will ask #SCOTUS to directly review court ruling that bars the Trump admin from asking a citizenship questionnaire on the Census, passing over the 2nd Circuit. documentcloud.org/documents/5691…
Unlike past instances where DOJ asked SCOTUS to act before appeals court rulings, DOJ is able to make a pretty strong argument for why they're going to be asking the justices to do so here:

#SCOTUS orders coming at 9:30a, followed by the possibility of opinions in argued cases at 10a.
BREAKING: #SCOTUS issues a stay of injunctions against Trump's transgender service ban, allowing the Trump administration to begin enforcing its ban while the case proceeds.
Justices Ginsburg, Breyer, Sotomayor, and Kagan all would have denied the stay — meaning this was a 5-4 decision.

Filing to establish Manafort breached his plea agreement. Unsurprisingly, most of the interesting stuff is redacted—but a reminder there are enormous chunks of this story the public knows nothing about. courtlistener.com/recap/gov.usco…
Couple interesting things that jumped out on first skim: Manafort was not only in contact with the administration (mostly via proxies) but working to “get people appointed”—which is to say, not just chatting, but exerting quite significant influence.
(I don’t want to overread, but the document says he was using an intermediary “to get people appointed”—not merely to TRY to get people appointed or recommend candidates, which implies he was, in at least some instances, successful in doing so.)

Paul Manafort's lawyers acknowledge that he failed to tell investigators about some conversations with Konstantin Kilimnik, who the FBI has linked to Russian intelligence. His lawyers said they "happened during a period when Mr. Manafort was managing a U.S. presidential campaign"
Bottom line from Manafort's lawyers: They don't want a hearing on whether he breached his plea agreement, though they say he didn't lie to investigators. The want to leave the issues for the court staff that'll prepare his pre-sentence report.

Prosecutors are asking Cohen receive a "substantial term of imprisonment" and not a light sentence as he's asked for, in part because his crimes were serious and he did not fully cooperate.
SDNY says Cohen does not have a cooperation agreement with them.

- you can subject-matter-waive even when testifying about different time period
To add to this list:

- criminal conspiracy’s “agreement” has some similar effects to strict contractual privity

- Trump faces numerous civil forfeiture proceedings in addition to criminal prosecution.
Finally (I gotta get up early):

The status report asks for evidentiary hearing on whether Manafort breached his plea agreement BY LYING. This would be in conjunction with the sentencing hearing, I suppose. But it’s not the sentencing hearing itself.

#Manafort charging document for today's guilty plea includes details of his planting disinformation in US press to smear political rivals of his pro-Russia clients in Ukraine. Eg "Plant some stink on Tymo"—painting a female rival as a criminal who paid for murder. Sound familiar?
Manafort had used the same propaganda smear tactics in Ukraine that Trump rolled out in his campaign for president in 2016. Manafort not only had Tymo soliciting murder. He pushed tribal divisions, using "Obama Jews" & anti-Semitism to tarnish her. assets.documentcloud.org/documents/4883…
#Manafort manipulated the media with disinformation and then used those planted news stories to manipulate US govt: "I have someone pushing it on the NY Post. Bada bing bada boom…The Jewish community will take this out on Obama on election day if he does nothing.”
