A lot of media friends, including senior editors have asked me why has @ArvindKejriwal headed Delhi govt expressed disappointment at Supreme Court's split verdict on Services & allowing Central control over ACB ? How earlier govts functioned ? I respond in the following thread :

At the core of this issue is Modi govt's May 2015 notification, issued barely three months after people of Delhi had elected their govt with highest ever electoral mandate in history of independent India. Through this notification, Modi govt illegally amended the Constitution

Through this notification, the Modi govt snatched Services and ACB from the elected Delhi govt. Constitution permitted Centre's control on Land, Police & Public Order in Delhi. Modi govt, however, took away another two key sectors of governance from the Delhi govt.

This notification should answer the sceptics and Arvind Kejriwal govt baiters who say how earlier govts, including Sheila govt functioned smoothly and why this current govt keeps saying all its powers have been snatched.

Services - means all officers & employees - from Class I to IV report to the Central govt through their LG - meaning the elected govt cannot even transfer a peon, elected govt does not even know how many vacancies exist in Delhi today and all employees can defy it to any extent

Is there any other example of such governance in India, where no employee reports to the elected govt, but to its politically opposed central govt appointed LG, who has all powers to transfer, post and take disciplinary action against entire staff paid salaries by Del govt ?

So therefore who ask how Sheila and other CMs earlier worked - the answer is in their tenures Services was them, there were some informal arrangements about principal secretaries and Chief Secretaries. This is the first govt which as been completely excluded in Services matters

It is the BJP and not courts, which has actually deceived the people of Delhi and in its bid to cripple the Kejriwal govt, the BJP under Modi-Shah even gave up its decades-old promise of statehood for Delhi. This BJP of Modi-Shah has even forgotten what Atal-Advani had promised

The first CM of Delhi after the Assembly was brought into existence following the 69th Constitutional amendment in 1993, late Mr Madan Lal Khurana, had famously stated, it is a C-class Assembly. Here is the link of what he had said :

Late Khurana ji's successor, late Sahib Singh Verma in 1997 said he would prefer to do farming rather than be a powerless CM :

Late Verma ji had introduced statehood bill in Delhi Assembly in 1998 :

It was none other than BJP founder and then Deputy Prime Minister & Home Minister of India Mr LK Advani who introduced Delhi Statehood Bill in the Lok Sabha in August 2003, which was cleared by Parliamentary committee then headed by Congress stalwart Mr Pranab Mukherjee

Delhi statehood bill unfortunately lapsed with the dissolution of the Lok Sabha in February 2004, and so did the decades-old promise of the BJP's founding fathers late Atal Behari Vajpayee and Lk Advani, both of whom had promised statehood for Delhi for decades in every election

This was followed by a Congress govt both at the Centre and in Delhi for the next decade - 2004 to 2014), Cong never wanted to give any powers to the elected Delhi govt, which was even clear the way 69th Constitution amendment & GNCTD Act were drafted by late Narasimha Rao govt

In this decade (2004-2014) BJP continued to deceive the people of Delhi by falsely continuing to promise Delhi statehood in case it was voted to power at the Centre. So much so that for 2014 Lok Sabha elections, BJP brought a separate manifesto for Delhi and yet again lied

Hatred of Modi-Shah for Delhi was visible in 2015 Assembly elections when for first time in more than two decades, statehood for Delhi was dropped from BJP vision document released for elections. Most humiliating defeat for the Gujrati duo of their career increased their hatred

What followed the Feb 2015 historic victory of @ArvindKejriwal has been a story of revenge, humiliation, treatment worse than a war enemy by the Modi central govt. Arrests, raids, illegal seizure of more than 400 files & open threats to bureaucracy to stifle and paralyse the govt

People of Delhi should know that the BJP which promised statehood for Delhi for decades, under Modi-Shah argued vehemently before Delhi High Court & Supreme Court that Delhi govt has no powers, it is merely for providing daily utilities under the supervision of the Central govt

Modi govt law officers stressed in High Court & Supreme Court that Delhi is a centrally administered territory, its elected govt can only give suggestions but it is upto the Centre whether it wants to accept those suggestions or not. They also argued LG is the overall boss

Every voter of Delhi should know that BJP's Modi govt openly stated in Court that elected Delhi govt is merely an extension of the Central govt, the Centre can treat it the way it wants & the Centre made it clear it does not accept the five-judge Constitution Bench verdict

This battle will be decided by the ultimate court of democracy - We the people.
Voters of Delhi have to decide whether their vote is inferior than the vote of people living in other parts of India ? Taxes they pay & representatives they elect - do they have any value or not ?

Basic Questions for those singing praises of Sheila - Did her govt have powers of transfers. postings & taking disciplinary action on officers and employees of Delhi govt ?
Did her govt have powers of filling vacancies through DSSSB ?
Did her govt have control over ACB ?

Does @ArvindKejriwal govt have any of the powers which the previous govts had on three issues mentioned in the previous tweet ?
Answer is a categorical NO
Can cynics and baiters any longer say Modi govt did not make a mockery of federalism ? Modi govt murdered democracy in Delhi

Finally, every Delhi resident must know the key to betterment of his/her city lies with them. Such illegal notifications, orders, will have NO bearing once they decide to teach a lesson to those who deceived them and made a mockery of their vote through threats and intimidation
