Note how Judge Amy Berman Jackson structured her new order on Roger Stone: it's significant. She made the new gag order terms part of the conditions of his pretrial release -- that is, part of the conditions of his bail. /1

/2 Why do so? Because persons with restricted liberty -- on bail, on probation, etc. -- may have their First Amendment rights restricted somewhat more than others. So, by tying the gag order to bail, Judge Jackson continues to avoid the harder question:

Defense wants to put Stone on the witness stand to explain himself.
ABJ says, re: putting Stone on the stand, "as long as you understand he's gonna be subject to cross-examination."

UPDATE: Judge Amy Berman Jackson is going to hold onto Roger Stone's case. In response to Stone's challenge to the govt's decision to designate his case as related to the DNC hacking prosecution, Jackson ruled that she "will take no action with respect to the current assignment"
