29 families separated from their children in the US and then deported are at the port of entry in Mexicali. @AlOtroLado_Org is demanding authorities give them their right to request asylum and be reunited with their children. Watch for updates...

A tremendous effort (by NGOs & lawyers, not the US govt) went into getting these parents closer to reunification with their children. This thread from @togetherrising gives you an idea

.@CBP keeps asking for proof these separated parents are who they say they are. @AlOtroLado_Org continues delivering it. So is there no space or does CBP not believe these people? Why have they been made to wait 6 hours (and counting)?

1/ THREAD: New details on the Trump #remaininmexico #asylum plan out now, and it's so much worse than I was expecting. This is an illegal, immoral, unconscionable human rights disaster in the making. Let's talk about what this is and how it's going to get people killed.
2/ Context: Asylum seekers in Tijuana and other border towns are being "metered" by an illegal system which requires them to take numbers on a list and wait their turn (sometimes months) to lawfully enter the US to seek asylum. This is already bad enough.

3/ Even before Trump, the nativist right was obsessed with the idea of making #CentralAmerican asylum seekers wait outside the US for the many years that it can often take to get these cases to a final hearing. This administration was all too willing to give it a try.

Top Myths About #Asylum and why you should care:

Myth: Asylum seekers should file at US consulates in their home countries.

Reality: Asylum can only be sought at the border or inside the US. US consulates do not accept asylum applications.
Myth: Asylum seekers must present themselves at a port of entry.

Reality: The law (8 USC 1158) specifically says a person may apply for asylum whether they enter legally or not.

They can be technically prosecuted for unlawful entry, but that doesn't prevent asylum.
Myth: Asylum is only for political persecution, not for fear of gangs and terrorists.

Reality: There is NO requirement in the law that an asylum seeker's fear be politically based.

I've won many gang and terrorist related cases.

2/ 1st, this is not exactly an executive order. That's coming later, via "Presidential proclamation"--obvs a totally cool & normal way to make things happen in a democracy

This "final interim rule" skips usual due process and goes into effect NOW, because #MigrantCaravan
3/ N.B.: This doesn't complete cut off all possibility of legal protection for #asylum seekers. "Withholding of removal" (a form of relief I like to call "asylum lite") and protection under the Convention Against Torture remain. That's not to say that this is necessarily OK.

As a fmr immigration attorney let me be unambiguously clear. Crossing a boarder to claim asylum is *not* a crime; no under US or international law. Any child separated from a parent under that pretext is done so in direct contravention to the laws of the USA. ⚖ THREAD Pls RT.
If you came to the US without permission to apply for asylum, youmetjod of entry, whether legal or illegal *should* in no way effect your application process. Illegal entry is not a ground of inadmissibility for asylum applicants.
Unlike many other categories of applicants for immigration benefits, ppl seeking asylum in the US are not barred by having made an illegal entry; for example, sneaked across the U.S. border or overstaying a valid visa (one of the top ways people are in the country illegall).
