Another sad day for immigration law: The Board of Imm. Appeals proved today that it is not only willing to openly violate our international treaty obligations, but that it really may not understand the basic concept of rogue cops operating with impunity in failed states.
Uniformed officers w/service weapons came to this #asylum applicant's door & violently extorted him, and the BIA went ahead and found that they probably weren't real cops...

because they told him not to tell the cops

And he should have reported to the real cops

what

WHAT
That is absolutely not how any of this works, as anyone who has given even a few seconds of thought to what it might be like to try to survive in a gang-compromised nation like Guatemala would understand.

Rogue cops do this kind of thing *all the time,* and no one can stop them

Just had to file my first application for an ICE detainee who entered the US after 7/16/19 & is now barred from #asylum (but still technically eligible for lesser forms of protection) under new Trump rule.

Said it before, but again: this is illegal, & it will get people killed.
The case will now be reviewed for a 51% chance of persecution rather than 10%. (Yes, the law really does reduce these life & death cases to betting odds.) Being barred from #asylum also means no chance of truly permanent status or pathway to citizenship.

All very much the intent
FYI my client presented near the Texas border seeking asylum & was immediately detained and flown to a county jail in Plymouth, Mass to await review by an #immigrationcourt.

You may have heard nativists talk about the "high costs of illegal immigration" ? This is the biggest one

LIVE now: PHR Asylum network member Dr. Todd @Schneberk testifies at @HomelandDems hearing on examining the human rights and legal implications of DHS' Remain in Mexico policy. #SaveAsylum #DefundHate
@Schneberk @HomelandDems My work has changed dramatically since the Trump administration rolled out MPP ... I regularly witness the dire impacts of the MPP and I am here to share my assessment that this program should be halted and defunded immediately.
@Schneberk @HomelandDems In February of this year, I was part of a PHR team that documented the cases of asylum seekers in Tijuana. These findings later formed the basis of a PHR report entitled, “If I went back, I would not survive.” phr.org/our-work/resou…

1/ I just read through the new proposed rules for #asylum-based employment authorization while waiting in #immigrationcourt with a 16-year-old asylum seeker, and I'm just so tired and angry that this seems like a good time to tell you how bad it is.

It's bad.

(1/5000000000)
2/ This opening sentence says everything.

In Trumpworld, the only possible reason anyone would file an application for #asylum is to get a work permit, and most of them are probably criminals.
3/ Under current regulation, #asylum applicants can't file for a work permit until their cases have been pending 180 days. (Under current processing times, they receive it about 30 days later.) This rule would double that to a full year.

Just returned from an almost week in family #detention with my team at the Center for Immigrants’ Rights Clinic (CIRC) @PSLCt4ImmRights @PennStateLaw There is so much I could say but at the same time what can I say? 1/
Phones are disallowed in jail so all of these pictures were truly moments...minutes we came together at sunrise or long after sunset. Some takeaways. moments...minutes we came together at sunrise or long after sunset. Some takeaways. 2/
1. I am so proud of the CIRC team who learned what it means to be a lawyer in all its messiness. 2. I am grateful to ALDEA - The People's Justice Center for their work everyday in family detention. 3. Watching kids cry, smile, and wail is very normal at home but not in jail. 3/

Thread: (1) New #asylum legislation will be voted tomorrow in the Greek parliament. Here are some points you might find useful to know regarding the process as well the content of the new law. #refugee
(2) All major national and international organisations have already criticised the gov for allowing only 5 days of public consultation as an effort to avoid scrutiny and warned the new law is leading to a backlash on human rights.
(3) The law introduces a series of measures aiming to restrict access, reduce times or terminate the asylum procedure. It also aims to expedite+increase the amount of people returned. The basis of this strategy is the re-introduction of en mass long term detention.

#HEUNI_Tweetsday Weekly thread on Wednesdays. This month we'll reveal you the key findings from our latest project done w/@SOLWODI, @CIRRIFUGIATI, @JRSizbjeglice, @ENoMW and supported by @EU_Justice
Simple rules: 1❤– 1 finding. 1st topic: #GBV, its consequences & risk factors.
@SOLWODI @CIRRIFUGIATI @JRSizbjeglice @ENoMW @EU_Justice So what are we actually looking into when talking about #GBV against women? Is there any definition? And where to find it? Check out #IstanbulConvention coe.int/en/web/istanbu… #VAW #HumanRights #ViolenceAgainstWomen
@SOLWODI @CIRRIFUGIATI @JRSizbjeglice @ENoMW @EU_Justice #Refugee women have different backgrounds including different personal qualities, family situations, levels of education and professions. Refugee women do not form a homogenous group, and they definitely should not be seen as uninformed #victims.

The asylum firewall is complete.

If Trump has his way (and that's an "if" the size of the wholeass Ukraine), no one but Guatemalans and Mexicans will be able to apply for #asylum at our southern border.
Remember that

1) all of these deals are almost certainly illegal on both sides, although admittedly

2) no one seems to know exactly what is in them

3) the July Guat deal isn't in effect and doesn't seem likely to be anytime if at all

4) any future POTUS could cancel them
Even with all of the above, this is a major story and I hope it isn't buried in impeachment news

1/ The Trump administration is about to achieve its longtime goal of setting up an #asylum firewall in Central America which will offshore our treaty obligations the worst possible places imaginable.

Let's look ahead to what this actually means in practice.
2/ Once Honduras inevitably signs, we'll have created a sort of buffer zone through which all asylum seekers coming from south of Mexico will have to seek asylum first. (Guatemalans will still be able to seek asylum at our border per current agreements.) Out of sight, out of mind
3/ Stephen Miller and other Trump #immigration policy minions have made it explicitly clear that there is only one purpose for all of this: to get these teeming masses yearning to breathe free as far from our golden door as possible, with no regard for their lives or the law

I regret to inform you that the terrorists have, and I just can't stress this enough, won.

#asylum
This is not a joke, and it's certainly not hyperbole. The perpetrators of 9/11 wanted to end this country as we knew it. They may not have predicted we'd do almost all of it to ourselves, but here we are
We've destroyed our own civil liberties, forgotten the meaning of the word "privacy," set up a Muslim registry (NSEERS, 2002-2011; still technically law), watched as proto-fascism took root, politicized our immigration system, & chosen the worst among us out of fear.

Now, this.

We are trying to declare the fire "safe" for people escaping the firing pan.

This is it. We're done. We are the baddies.

I hope I live to see my country recover from the shame of this
A "regional issue"?!

Imagining burning down an entire neighborhood and refusing to help the displaced victims. Making them house and care for each other. Torturing and bullying them if they have the temerity to come to you, the perpetrator, asking for help.

Thread: the Trump @StateDept tampered with key evidence for women's #asylum cases, and undermined the impartiality of our human rights reporting system. Fellow immigration attorney Joanna Gaughan caught them red handed:
2/ Every year @StateDept releases a report on each country's human rights practices. @TheJusticeDept immigration judges and @DHSgov asylum officers use these reports as evidence for asylum cases & emphasize them over other sources bc DoS is considered impartial and reliable.
