Cox is set to finally table new legal text on backstop when he meets Barnier today. Talks are focussed on fleshing out 'good faith' provisions as outlined in Art 5 of WA and how they apply to Art 184 (trade talks) and Art 20 of IE protocol (review clause). thesun.co.uk/news/brexit/85…
Or in plain English, the UK & EU looking at setting out how the UK can use the good faith obligation in the (legally binding) Withdrawal Agreement to challenge and exit the backstop if the two sides don't agree a trade deal along the lines of what's in the Political Declaration.
Worth remembering review clause specifically states future UK-EU provisions could lead to backstop being superseded 'in whole or in part' depending on what criteria for avoiding a hard border they meet. So could end up in situation in 2023 where only part of backstop is applied.

1/ Geoffrey Cox has scrapped a planned visit to Brussels today for further negotiations because the gulf between the EU & UK over what legal assurances will cut the mustard is so wide. So, what are both sides offering? The latest from me and @tnewtondunn 👇thesun.co.uk/news/brexit/85…
2/ First, the UK offer. The Attorney General tabled proposals for a new, independent arbitration system to rule on when the backstop could be ended. He said the question it should be asked is whether the UK had shown sufficient good faith in coming up with alternative solutions.
3/ If this arbiter said Britain's efforts on alternative arrangements and attempts to strike a trade deal with the EU had been good enough both sides would enter what Sabine Weyand dubbed the 'mini-backstop' - a stripped down backstop only addressing border infrastructure.

Commission spokesman: 'Barnier informed Commissioners that while the talks take place in a constructive atmosphere discussions have been difficult. No solution has been identified at this point which is consistent with the WA including the protocol on NI which won't be reopened.'
Attorney General Geoffrey Cox: 'We're into the meat of the matter now. We have put forward some proposals, very reasonable proposals. Both sides have exchanged robust, strong views and we are now facing the real discussions. Talks will be resuming soon.'
Commission spokesman adds that Barnier 'offered ideas on how to give further assurances' that the backstop will only apply for as long as necessary, unless and until it can be replaced by a future trading relationship. He adds that further technical talks will carry on all week.

Internal row brewing between Council/Parliament vs Commission over creation of new EU Space Programme & post-Brexit UK's place in it. Member States & MEPs have agreed on it. But Commission seems to fear it could open a loophole for UK to keep decision making powers on Galileo.
Commission spokes: 'In case of UK withdrawal from EU, Commission has been consistent 3rd country access to development of security sensitive matters such as manufacturing of PRS security models is not possible. We have a duty to defend institutional prerogatives of this house.'
EP President Tajani: 'Commission should intervene only in case the agreement reached distorts the proposal in a way that prevents the achievement of the original objectives. I hope the agreement will be respected together with timeline foreseen for adoption of Space Programme.'

A not-so-short thread which I hope simplifies a seemingly never-ending process but one which could have an abrupt end in less than 40 days. /1
Some context first: The key problem is the backstop - the Irish Protocol to us its proper name

It’s a section of the Withdrawal Agreement (WA) - a 585-page legal text which, together with a shorter Political Declaration (PD), forms the divorce treaty between UK & the EU. /2
The two texts - the WA & the PD - were the consequence of nearly two years of negotiations.

They were finalised + agreed by both the UK government (@10DowningStreet) and the EU (@EU_Commission) late last year. /3

1. A few predictions based on my reading of the news flow over the last 24 hours. All speculative, as usual.
2. We’re heading, I think, towards some sort of legal text ‘temporary’ backstop fix. This may or may not come over the next few days but let’s assume it does.
3. FAOD this conclusion while helpful would be a far cry from Brady let alone Malthouse. But, for the reasons everyone knows, this would not be a surprise.

Morning all. Court starts at 10 this morning with some housekeeping. Check back in around 10:30 for an update.
Housekeeping over. Government forced to “unreservedly apologise” for blowing court deadlines before hearing. Court currently considering sanctioning Government.
We’re back: Court orders Government to pay @libertyhq’s costs as consequence of blowing pre-hearing deadlines. The theme of Govt thinking rules don’t apply to them, and the Court needing to remind that they do, guaranteed to resurface later today.
