The three-judge panel's recent McKeever decision ran counter to the en banc (full court) decision in the key Watergate case, and 12 of the 22 DC Circuit judges are Dem appointees. If it gets reversed, Congress likely gets the Mueller report unless SCOTUS intervenes.

In Nevada v Hall (1979), which SCOTUS just reversed, a Nevada employee caused an accident on a Calif. highway. Nevada argued that the Californians it injured IN CALIF. (a) couldn't sue in Cal., or (b) at best were limited to $25k damages per NEVADA law. 1/
On its face, the new decision is just about whether one state can be sued in the courts of another state. But there are deeper issues here:
1) As the dissent notes, this signals that SCOTUS is willing to jettison ALL precedent. Precedent like, you know, reproductive rights.

2) And the "$25k cap" issue in Nev v. Hall raised an old, old Q: to what extent must one state's courts + citizens honor an unfair law passed by another state? If you're thinking that sounds vaguely familiar, you're right: that was the issue in Dred Scott v Sandford.

For Mother's Day my wife wanted Thai food. We ordered via @Grubhub @Grubhub_Care, but half our order was missing. It's taken an hour to get them to re-order the missing food, and even then the agent said she couldn't expedite delivery or offer any credit for the delay. Not cool.

@batesunlv Most media accounts covering Nadler's subpoena and Barr's response aren't distinguishing between the "unredacted Mueller report" and his associated request for the underlying GJ evidence (which Barr says runs to "millions of pages").

@batesunlv That has me chewing on the historical precedent: Did Sirica at any point distinguish betw. the "roadmap" and the famous "briefcase" of Watergate evidence delivered to House Judiciary along with it? And was the "briefcase" evidence part of what you got released?

THREAD: I invoked Rod Serling & Twilight Zone when the news hit about #Trump asserting #ExcutivePrivilege over documents underlying #MuellerReport. I thought I should explain given your questions about US v Nixon & more.
First, there are two different issues to sort through. 1. grand jury material redacted in #MuellerReport and the grand jury material - documents - the report relies on; and 2. documents like McGahn's notes that Mueller refers to in the report that may exist outside of grand jury
House Dems are basically arguing they can see grand jury material behind closed doors (not public) without a court order. The Congressional Research Service notes that 2 court decisions agree with them & others do not. This sets up a court battle. fas.org/sgp/crs/secrec…

1. IMO House should open impeachment proceedings but obstruction should not be principal focus. He obstructed to conceal treason. That should be focus & what any reviewing court would have for the basis for urgency to act immediately to overrule further @WhiteHouse obstruction.

Barr made it perfectly clear in his testimony today that he is obdurate and will remain obdurate about handing over the grand jury materials that House Judiciary Committee chairman Jerry Nadler has requested. 1/62
Nadler has authorization from the committee to subpoena Barr for the materials, but he is waiting to see the redacted version of the MUELLER REPORT that Barr is preparing before he actually sends the subpoena. But clearly, Nadler is expecting the worst. 2/62

The @rcfp (Reporters' Committee on Freedom of the Press) will not like today's decision in #McKeevervBarr. "Because the district court has no authority outside Rule 6(e) to disclose grand jury matter, the order of the district court denying McKeever’s petition is Affirmed."
