Much work for QCs: not so good for anyone else.
Some footnotes.
1. The reason why the Trade Bill is stalled is because the HoL attached provisions to it that include: making coming into force of the Bill conditional on a withdrawal agreement or a HoC motion approving no deal (clause 22);
requiring the Government to negotiate a mobility framework with the EU permitting U.K. citizens to live work and study in the EU27 “for the purposes of trade in goods or services” (clause 10); and
requiring the Govt to negotiate a customs union with the EU (clause 8).
The Government is not confident that the HoC will reverse those amendments.
2. Absent enactment of the Trade Bill, we have a trade remedies regime (in the Taxation (Cross-border trade) Act 2018) but where the key player in the regime (the Trade Remedies Authority) does not legally exist.
@tradegovuk believes it has a fix for this slightly Lewis Carroll situation: but we shall see if it works.
3. The @instituteforgov doesn’t deal with other legal messes created by no deal eg in cross border disputes (commercial/family/crime) where rules about eg cross border divorces, cross border contract disputes and extradition will all be disrupted.
Again, more work for QCs. Bad for anyone else. /ends
