This morning we should hear whether our application for interim - ie pending the final decision - relief before the Outer House against The Charlatan's suspending of Parliament has succeeded. /1
If we have succeeded, good, the Courts have risen to the occasion and are protecting us from Cummings' constitutional vandalism. /2
But if we have failed, remember that in the Outer House twice decided against us - at the permission stage and at the substantive stage - in the Wightman case and both times was overturned on appeal. /3
Either way, this case will go very quickly to the Inner House of the Court of Session - Scotland's Highest Court - and then to the Supreme Court. So reluctantly I have reopened the crowdfunding: crowdjustice.com/case/dont-susp… /ENDS

Dan's argument is in effect that if there is a majority in Parliament for a ninety day extension there must also be a majority in Parliament for a ninety year extension. That's palpable nonsense.
But ultimately the point is this. Parliamentary sovereignty is our constitutional Ground Zero. The EU Referendum Act 2015 in enacting an advisory referendum left to Parliament the choice of what to do with the result. 1/2

Seriously? Is there any precedent for a Government in a functioning state to indicate it regards its compliance with the law as voluntary?
So they've cancelled Parliament and now indicate they'll obey the Courts only when they want. That leaves an Executive, chosen by 90,000 disproportionately elderly, wealthy, white men, in pretty much sole charge.

This, by @bernardjenkin, is really poor. It just ignores as inconvenient at least twelve factors, that: (1) MPs voting in the 2015 Referendum Act could have chosen a binding referendum, as with the referendum on AV, but they chose an advisory one;
(2) the choice at (1) left them and not the Government with control over what happened next because leaving the EU would require primary legislation;
(3) during the course of the campaign No Deal was never suggested by Leave to be a possible outcome and one cannot pretend the result in 2016 was a mandate for it;

To clarify (since there is confusion): Semenya is at the appeals process in Swiss Federal court. Today’s ruling is that the IAAF DSD Regs requiring her to lower T must be suspended until a final decision on her appeal. The IAAF have until 25 June to argue against this “delay”
What does this mean? Final decision by this court is expected to take 6 months. So one scenario is that the IAAF can’t convince the court to overrun the “delay”, so all DSD athletes can continue to run, unmedicated, until December. Then the final decision will decide the future
Another is that the IAAF does win their “mini appeal” against the stay, and then the policy would go into effect from June 25. Then the actual appeal continues in the background for 6 months. This is the “on, off, on, off, on” scenario, pending a final decision by the Swiss court

White House: "At the attorney general’s request, the president has no other option than to make a protective assertion of executive privilege" over the subpoenaed Mueller report documents.
AG Barr letter to President Trump requesting him to assert executive privilege:

"In these circumstances, you may properly assert executive privilege with respect to" subpoenaed materials "pending a final decision on the matter."

Morning All. After reading Jiti Ogunye's piece on the CJN, I have this to stay. The FGN was not wrong in any way. The FGN acted on an order of the CCT. If Jiti is saying that the CCT erred in giving the order, he knows that error can only be decided by an appellate court.
There is no error when you act on the order of a court of competent jurisdiction. The FGN did not take laws into its hands they did not forcibly remove the CJN, a court that had that power did so & that order was an interim (till 28th Jan) and not interlocutory order as Jiti said
Interlocutory means till the end of the trial before the CCT like Jiti said, but the CCT gave an interim order pending the determination of the Motion on Notice where all parties would have argued the application seeking the CJN's step aside till end of the case. FGN did not err.

What’s the main point? Should Europe (or France’s #privacy regulator) be able to apply its rules over the internet worldwide.

A recap:
La Vanguardia, a Spanish newspaper, published records in the late 1990s detailing the debt delinquencies of Mario Costeja.

About a decade later, Costeja sued, saying that the publication breached his right to privacy.
After a lengthy legal dispute, the case was referred to the ECJ which, in 2014, ruled that individuals had the right to ask that search engines like @Google remove links (but not the underlying webpages) from search results

Before I lose the idea. R76 and wax museum challenge.
I'm thinking Jack as a journalist, challenged to do the "one night in a wax museum" thing. (Since he lost a bet in his journalist company).

His boss wants a segment of his experience or something so Jack takes a vid camera, sleeping bag, notebooks and some necessities
His bet requires him to set up in the 'murderers' section for maximum fear factor and what not. Jack admits he's a little scared cause everything looks so real.

One of the statues is a guy called Gabriel Reyes. The story was that he murdered people around the city.
