Can you see someone being fed a barium leak? Unknown WH officials expressed concern about the call.
But it has nothing to do with the jurisdiction of the DNI & ICIG for an urgent complaint!
Even more importantly, though it falls outside the scope for ICIG to notify Congress, it does fall within the scope requiring the IG to notify the AG of the allegation!
There is nothing resembling this complaint in the transcript that was released today! This was either a barium leak or completely fictional complaint!
Of course, ICIG ruled that if a senior US official asked a foreign official to help with an election campaign that would be a serious abuse or violation of the law.
So we now have a legal ruling that asking Ukraine to interfere in the 2016 election was a serious abused of power.
I wouldn't want to be Clapper right now!

ICIG has determined that a DNI ignoring senior officials colluding with Ukraine to rig the 2016 election is clearly within his responsibility & authority!

SO no statutory requirement to disclose the complain to Congress.
The President conducting foreign policy is not an "intelligence activity" & is thus not covered by the ICIG's duty to report to Congress.
The ICIG statute also omits the Executive Office of the President from it's compliance activities over the intelligence community.
The ICIG had no authority to investigate the issue and thus no authority to report it to Congress.
The ICIG does not have authority to investigate foreign threats to the US including the threat of foreign election interference. Instead, the ICIG is required to notify the Department of Justice of the allegation to allow them to investigate.
So this allegation belongs to Attorney General Barr!

But also establishing that an IG can investigate outside parties if they are colluding or conspiring with employees or officials within the jurisdiction of the IG. Going back to Acting DAG Barr for that precedent!
So anyone who conspired with the IC Whistleblower would be within the jurisdiction of the IG!

Oh, it's been referred to the DOJ Criminal Division for further investigation!
