Maguire says he had to notify DOJ to air the president to decide whether it not to assert executive privilege. But:
1. Perhaps surprisingly, Congress has never agreed, and SCOTUS has never ruled, that Executive Privilege applies to Congressional hearings. ...

2. Let's analogize to another privilege. If a whistleblower's complaint alleged an illegal, dangerous conspiracy between a member of the IC and their lawyer, would the DNI notify the lawyer to allow her to assert attorney-client privilege?
