One of my DACA clients was erroneously arrested by the SFPD under suspicion of drunk driving. When he filed to renew his DACA, his fingerprints showed that he has an arrest for a DUI, which would make him ineligible. CIS issued an RFE asking him to “prove” that he had not been /1
convicted of and/or committed a DUI. Although the SF DAs office neglected to file any charges they also refused to give him a letter stating that they would not file any charges because the charges were baseless. Although we submitted a statement from our client and his public /2
defender, because SFDA has 1 year to file misdemeanor misdemeanor charges in California and because it is impossible to prove a negative, his DACA status was revoked. Do you think that would have happened if he SFDA had an immigrant affairs unit cognizant of the human impact /3
of its refusal ti issue a simple letter outlining the truth of what had occurred? I don't. Local elections, especially for the district attorney, matter a whole lot. Find out who is running and what their platform is. Vote for the best candidate and hold them to their promises.
