For the constitutional nerds and pedants, I’m re-upping my post on *why* a first minister gets to meet the Commons first, regardless of the electoral results. It’s a legal reality nested in the Crown’s prerogative and the conventions that surround it: lagassep.com/2018/09/28/sti…
The prerogative to appoint and dismiss ministers predates the conventions of responsible government and popular democracy. And the prerogative itself pre-dates Parliament as the supreme legislative authority. We’re deep into the historical constitution here.
Other jurisdictions have infused more modern practices around this prerogative, either by having the ministry resign and be reappointed after each election, or by giving the legislature a role in nominating/confirming the first minister. We’re old school in Canada, as per usual.
Finally, we should note @justinmassie1’s observation that the end result will probably be traditional, boring, and typically Canadian in its lack of excitement. So, we only have a few days left of counting angels on constitutional heads of pins!
