The facts of this case appear to be almost exactly the same as those in Tennessee v. Garner, the 1985 case in which the Supreme Court made clear that police ofcrs cannot shoot a fleeing suspect unless it is reasonable to believe they constitute a danger. supreme.justia.com/cases/federal/…
Edward Garner was 15, running away from officers and jumped over a fence. He was shot in the back of the head by pursuing ofcrs. The Court found that the ofcr "could not reasonably have believed that Garner - young, slight & unarmed - posed any threat." supreme.justia.com/cases/federal/…
Murietta Golding was 16, running away, climbs a fence and is shot in the back of the head by a pursuing ofcr. That one ofcr says "good shot" after the teenager is shot in the head is a horrifying fact, that is blessedly not part of the facts in the Garner case.
