Today ICE counsel asked my client 15-20 Qs on cross about why she hadn’t presented more evidence in her asylum case. The argument was clear - she failed to provide corroborating evidence. Only ICE/EOIR put her on the expedited FAMU docket and she had 1 month to prepare her case.
They are literally shoving ppl onto expedited dockets so they can’t get counsel or have time to present their cases and then they are using the fact they don’t have enough time to prepare to try to deny their cases. Imagine being the kind of attorney willing to argue that.
The govt also argued that a 5 year old having her stomach slashed open by a gang member and being bedridden for 3 months as she healed with ongoing psych symptoms/trauma wasn’t enough to show past persecution. Their position is clear: ICE thinks no one qualifies for asylum.
