No coherent response by @DouglasCarswell to my question on exactly what bits of the current judicial review test he objected to. Instead, an immediate ad hominem attack (along the lines that lawyers like JR) and a vague complaint that judges just substitute their own decisions.
Those that argue that judicial review needs to be cut back need to do better than that.
And @cath_haddon made an excellent follow up on the lack of any evidence base whatsoever for @DouglasCarswell’s claim that JR frustrates attempts to improve public administration.
Being told you have exceeded your powers or failed to listen to someone who should in fairness have listened to is frustrating for Ministers who want to move fast and break things.
But it is basic to the rule of law and to good government that public bodies act fairly within the powers Parliament has given them.
