Wow. Caldwell’s argument is pretty much the same as the segregationist case that the Civil Rights Movement, and eventually the CRA itself, represented the destruction of “free enterprise” principles.
As I write, “Segregationists understood the ‘freedom’ in free enterprise to sanction the autonomy of white merchants to employ and to serve whomever they wished. At the extreme, they could argue, as did Lester Maddox” that “we have a divine right to discriminate” (p. 205).
Later on that page, I quote William F. Buckley, who condemned those who sought (illegitimately, in his view) to “instruct small merchants in the deep South on how they may conduct their business.”
I also quote the Southern Agrarian Richard M. Weaver who in 1957 complained that “racial collectivism” was “being used as a crowbar to pry loose rights over private property.” For the same reason, he decried the Shelley v. Kraemer decision overturning racial covenants.
