Thread: I am FURIOUS. Committee on Codes of Conduct of the U.S. Judicial Conference is looking to ban judges from belonging to the Federalist Society OR American Constitution Society. This is wrongheaded and will make a worse judiciary. @FedSoc
@FedSoc 1) if you think either are big bad influences, this just pushes activity behind scenes, into dark. 2) In reality, this will just serve to exclude judges from the legal community!!!! When judges come to FS or ACS, they can teach and learn with lots of professionals and students
@FedSoc I've been a fed soc member since I was 16. So I just get to hang out with federal judges at their conferences, ask them questions, ask them for reading ideas, etc. Long before I was really in policy. This would take that away.

And I know judges learn at these events too!
@FedSoc Some may not be as into one area of law and get to see debates on the edge of new legal ideas and info. They can still watch online I guess, but this is silly.
@FedSoc @WSJ editorial is dead on.

"The draft is what we feared, and we hope judges and others blast it as undermining legal education in America and perhaps violating the First Amendment right of association."
@FedSoc @WSJ I won't get into it now, but current and former fed employees' 1A rights are often unduly restricted in ways you might not expect. Anyway.
"This is political mischief masked in high-sounding rhetoric."

@WSJ is right. For one, attend ANY @fedsoc event and everyone is arguing!!! NO positions are endorsed. You have people on all sides of issues.
@WSJ @FedSoc I've even asked @fedsoc to get involved with some of my and others' that were very neutral and they've turned them down bc they're THAT cautious.

People come to @FedSoc FOR the debates. That's why you go. That's why I've gone since I was 16.
@WSJ @FedSoc ACS is also way more political than Fed Soc, but I don't think judges should be barred from either.
@WSJ @FedSoc So what, judges could still speak at fed soc but not one on one to aspiring law students? Could they do podcasts? This is silly
@WSJ @FedSoc RIDICULOUS.

"The Codes of Conduct draft also advises law clerks not to join the Federalist Society, which means young lawyers in their formative years may avoid membership to avoid any future damage to their careers."

I've met all kinds of luminaries - many of whom disagree...
@WSJ @FedSoc ...at fed soc. GREAT IDEA LET'S BAN UP AND COMING LEGAL MINDS FROM HAVING EASY ACCESS TO SMART PEOPLE. FAN FREAKING TASTIC.
@WSJ @FedSoc So in sum, let's make sure judges don't have easy access to law students, and clerks don't have easy access to scholars so nobody can talk and learn. This is horrific. I'm sure it's same at ACS, but from my experience at @fedsoc like I AM NOW FRIENDS W THE GUY WHO ARGUED RAICH.
@WSJ @FedSoc I'M NOT EVEN A LAWYER BUT I GET TO MEET AND BECOME FRIENDS WITH @RandyEBarnett @ishapiro @jadler1969 @ConLawWarrior and innumerable others, let alone @JusticeWillett!!! WHY IN THE WORLD would you want to ban judges from easy access to brilliant minds and growing students??
@WSJ @FedSoc @RandyEBarnett @ishapiro @jadler1969 @ConLawWarrior @JusticeWillett I want more legal orgs with different perspectives and I want judges and clerks to join them all!!! I want everyone to nerd out together and learn from one another. This ideas is atrocious and needs to be stopped.
@WSJ @FedSoc @RandyEBarnett @ishapiro @jadler1969 @ConLawWarrior @JusticeWillett I mean like bc of Fed Soc I just DM @OrinKerr sometimes to ask what I should read to learn about 4A law... or @Laura_K_Donohue because I love them both and they disagree! Why would anyone want to restrict this access?
Damnit everyone great job i was so mad i forgot to link the article wsj.com/articles/judic…
