So @HomelandKen is no leader of @USCIS—more than that, he never was one.

This is a big win for @DemocracyFwd @RAICESTEXAS @cliniclegal @Debevoise & the #asylum seekers they represent.

Immediately, two misbegotten asylum policies are nullified.

Not regulations, to my knowledge, since those are signed by the DHS Secretary.

But the Director of USCIS signs plenty of orders on their own, not just the ones at issue in this lawsuit...

There's already a challenge by @protctdemocracy & others against the rollback of USCIS fee waivers, partly on the same Federal Vacancies Reform Act grounds that just dethroned The Cooch in a different court.

1/ I just won my first case under the Trump admin's new rule barring anyone who entered after 7/16/19 from #asylum--but leaving them eligible for other limited forms of protection.

It's a strange feeling of having won & lost at the same time. Happy, but not celebratory.
2/ My client is from a country in crisis, which he fled after being kidnapped & tortured by govt-affiliated forces for his anti-regime activity.

This would usually be a fairly clear-cut case of political asylum. But not under this administration.
3/ The new Trump rule makes anyone who didn't seek asylum in another country first ineligible for #asylum--but (as required by intl law) still allows them "withholding of removal," a far more tenuous status which, unlike asylum, does not put recipients on a path to citizenship.

1/ BREAKING: #ASYLUM LAW

As #impeachment dominates the news cycle the war on #asylum still rages... and the Trump administration just dropped another daisycutter.

This whole thing is *far* worse than this headline might suggest, so let's just into it.
2/ 1st, remember that "criminal aliens" is one of the Trump administration's favorite phrases, intentionally used to associate crime w/refugees, asylum seekers, &Central Americans generally. (MEDIA: This is a very knowing psy-ops campaign; please don't perpetuate it)
3/ International law *does* allow member states of the Refugee Convention to restrict the right of asylum to those convicted of "particularly serious crimes" and even return such people there even knowing they face will face persecution. It's clearly for extreme cases.

Another sad day for immigration law: The Board of Imm. Appeals proved today that it is not only willing to openly violate our international treaty obligations, but that it really may not understand the basic concept of rogue cops operating with impunity in failed states.
Uniformed officers w/service weapons came to this #asylum applicant's door & violently extorted him, and the BIA went ahead and found that they probably weren't real cops...

because they told him not to tell the cops

And he should have reported to the real cops

That is absolutely not how any of this works, as anyone who has given even a few seconds of thought to what it might be like to try to survive in a gang-compromised nation like Guatemala would understand.

Rogue cops do this kind of thing *all the time,* and no one can stop them

1/ I just read through the new proposed rules for #asylum-based employment authorization while waiting in #immigrationcourt with a 16-year-old asylum seeker, and I'm just so tired and angry that this seems like a good time to tell you how bad it is.

2/ This opening sentence says everything.

In Trumpworld, the only possible reason anyone would file an application for #asylum is to get a work permit, and most of them are probably criminals.
3/ Under current regulation, #asylum applicants can't file for a work permit until their cases have been pending 180 days. (Under current processing times, they receive it about 30 days later.) This rule would double that to a full year.

1/ The Trump administration is about to achieve its longtime goal of setting up an #asylum firewall in Central America which will offshore our treaty obligations the worst possible places imaginable.

Let's look ahead to what this actually means in practice.
2/ Once Honduras inevitably signs, we'll have created a sort of buffer zone through which all asylum seekers coming from south of Mexico will have to seek asylum first. (Guatemalans will still be able to seek asylum at our border per current agreements.) Out of sight, out of mind
3/ Stephen Miller and other Trump #immigration policy minions have made it explicitly clear that there is only one purpose for all of this: to get these teeming masses yearning to breathe free as far from our golden door as possible, with no regard for their lives or the law
