Supreme Court starts hearing the plea of Anjuman Intezamia Masjid, challenging the order of Varanasi court which ordered a videographic survey of the #GyanvapiMosque complex, which is adjacent to the famous #KashiVishwanathTemple in Varanasi.

Senior advocate Huzefa Ahmadi, appearing for #AnjumanIntezamiaMasjid Committee, starts arguments - says that the prayers filed by the #Hindu side in the #VaranasiCourt categorically speak about changing the character of the structure, which is a #mosque.

Senior advocate Huzefa Ahmadi says - We were apprehensive of the appointment of advocate-commissioner. We asked, why are you cherry-picking a person for the commissioner to do the survey?

Senior advocate Huzefa Ahmadi says - On Saturday and Sunday, Commissioner went to execute the survey, and Commissioner was fully aware that matter is pending before the Supreme Court and is listed before this bench.

The advocate further says - Varanasi Court on Monday ordered to seal a spot in the complex after being told by the Commissioner that a #Shivling was found inside the Gyanvapi Mosque premises.

Supreme Court tells Masjid Committee that it will order the trial court to dispose of your application under Order 7 Rule 11 (for rejection of plaint).

Senior advocate Ahmadi for Masjid Committee says he is seeking a stay on all the orders of the trial court including the appointment of a commissioner and status quo should be ordered as these orders are illegal and against a law of #Parliament.

Senior advocate Ahmadi for Masajid Committee says - Premises cannot stay sealed and the orders are illegal. If premises are sealed, there is alteration of the status quo. Section 3 of the Places of #WorshipAct makes it clear that it can't be done.

Supreme Court says the trial court directed the DM Varanasi to seal the premises where #Shivling was found and entry into the #Wazukhana was restricted and said that it will not be used and only 20 people will be allowed for prayers.

Supreme Court says it can issue notice; observes - till the next date of hearing we will issue a direction that DM Varanasi will ensure that the Shivling area will be protected but it will not impede access of Muslims to the mosque for prayers.

Supreme Court observes that it will pass order and protect part of the order where the Shivling was found, but the rest of the order is stayed. We will say that if the Shivling is found then the DM will ensure security to the area - the court observes.
