borden’s attorney, hallahan, is stuck in traffic on 64 and may be an hour or so late. sticking around near the courthouse & catching up on some work on this beautiful mornbrvM
and we’re back in the courthouse! daniel borden, one of the assailants in the august 12 assault of deandre harris, was scheduled to go to trial 6/5. the docket shows an arraignment today... he’s likely changing his plea to guilty. more soon.
borden entered a plea of guilty to the felony malicious wounding charge. his lawyer clarified that he admits guilt on the assault & battery unlawful wounding charges, but it’s an alford plea to the malicious wounding - “he did not have malice in his heart.”
judge moore disagreed — borden was across the street when the assault began. like ramos, borden ran to join a beating in progress. and unlike the two men already convicted of malicious wounding, borden struck harris with a weapon. the judge found him guilty of malicious wounding.
the sentencing hearing will be october 1 at 11 am. both the commonwealth and the judge said borden’s sentencing should be after ramos’ and goodwin’s - both scheduled for august 23.
the maximum sentence in all three cases is 20 years.
juries in goodwin & ramos’ trials recommended ten years and six years, respectively. virginia juries make sentencing recommendations, but in all three cases, the judge will hand down the final sentence.
the commonwealth offered only a brief summary of the evidence, declining to show any of the video - the judge agreed that borden had been sufficiently identified in the video shown at goodwin & ramos’ trials. defense didn’t object.

ACA antony hinted that we may see at sentencing some social media comments borden made after the assault. perhaps he, like goodwin, had been bragging about his involvement.
at the time of the assault, goodwin was wearing a helmet that said “commie killer.”
remember this post ramos made in the immediate aftermath of the assault? hard to argue against malice or for remorse.
borden drove here from ohio looking for violence.
he looked very different today in his gray striped jumpsuit.
a presentence investigation report and a victim impact statement will be prepared ahead of the sentencing hearing in october. i’m curious where the judge will come down on this...
borden was three weeks shy of his 19th birthday at the time of the assault. he has an 11th grade education and is working on a GED in jail.
but he used a weapon. he sprinted into a brutal group assault and struck a prone man.
a little surprised we didn’t see junior court reporter jason kessler this morning! i guess he’s got court worries of his own this week.
still, he missed an opportunity to get some advice from hallahan - borden’s lawyer & kessler’s for his perjury trial. hallahan also took the VA bar without attending law school. kessler has the distinct disadvantage of no longer being legally allowed in the law library, thouL5N8
