After casting the deciding vote to reinstate Trump’s Muslim ban, Justice Kennedy wrote a 1 1/2 page opinion in support of his decision.

It was the weirdest SCOTUS opinion I’ve ever read.

It essentially said “Yeah, this sucks but, hey, he’s the president... but presidents really shouldn’t do this kind of stuff... because it sucks.”

It was a judicial nothing-burger. Read as more of a defense from criticism of Kennedy himself than meaningful opinion on the matter.
In light of the now-swirling talk of whether Kennedy had entanglements which call his rulings into question, it feels even more like that.
What better way to blunt criticism of a ruling that will assuredly be scrutinized than by saying:

“Guys, I didn’t want to rule this way but my hands were tied.”

This whole thing feels hinky AF.
There may be no impropriety. There may be no “conflict of interest” that rises to the level of crossing judicial lines.

It sure raises questions though... and they certainly deserve answers.
