I don’t think it suggests that —“If a nonoriginalist precedent is truly part of the constitutional fabric, the Court will not be asked to reconsider it, nor does a commitment to originalism require that any Justice volunteer to do so.”— but Dems will argue it does.
Which is why at least a couple of years of opinions and bench practice on Federal Court questions is best stepping stone to #SCOTUS and path through confirmation. @realDonaldTrump knows he cannot swing and miss here which points to Kavanaugh or Kethledge, w/the latter being the
easiest to confirm, the most potent politically in the 2018 and 2020 Elections, the judge who motivates the Free Exercise and 2d Am portions of the base most, and who is as accomplished as Kavanaugh, who would also be a terrific Justice but who would have to battle through
the Starr report, the torture memos and a small but vocal part of the Rove-hating base. Kethledge would surprise b/c he isn’t well known but would quickly become so. @realDonaldTrump wants a win and “the Gorsuch-Kethledge Trump team on #SCOTUS” has appeal as well as originalism.
