Last wk, the court questioned whether Manafort’s allegedly fraudulent representations to FSB to obtain a total of $16 million in loans "could be material" if FSB chairman and CEO Steve Calk, intended to grant Manafort the loans in exchange for a spot in the Trump admin anyway
Picking up on the court’s comments, the defense suggested that Manafort could not have defrauded the bank if Calk knew Manafort’s representations were false," the 9-page brief states.
According to the special counsel, even if Calk was the decision-maker with respect to the loans, “a finding of materiality is not depend[e]nt upon whether the fact finder was actually influenced by [Manafort's] false statements."
Even if Calk had not ended up approving the loans, Manafort would still have conspired to commit bank fraud, prosecutors argue.

For now, Trenga has asked that defense attorneys file any motion to continue by Jan 21. A hearing on that motion will be held Feb 7.

Good morning from inside the media room at the USDC Eastern District of Virginia. Bijan Kian's status conference with Judge Trenga gets underway this morning at 10AM. Story to come @CourthouseNews. Trial set for Feb, so today I'm expecting negotiating around docs/schedule etc.

House Dems released their rules package last night. Vote goes down this week. Here's a taste of whats inside as House Dems push for a return to "regular order":
- Bills that go thru the Rules committee must have a hearing and markup session before going to floor

This first count #Manafort admits to is violation of 18 USC § 371, "Conspiracy Against the United States."

What does that mean? He conspired to commit a crime against the US or to defraud the US:
A conspiracy, definitionally, requires more than one conspirator. Who did Manafort conspire with? The first paragraph dealing with Count 1 names Richard Gates and Konstantin Kilimnik "and others"

#Manafort charging document for today's guilty plea includes details of his planting disinformation in US press to smear political rivals of his pro-Russia clients in Ukraine. Eg "Plant some stink on Tymo"—painting a female rival as a criminal who paid for murder. Sound familiar?
Manafort had used the same propaganda smear tactics in Ukraine that Trump rolled out in his campaign for president in 2016. Manafort not only had Tymo soliciting murder. He pushed tribal divisions, using "Obama Jews" & anti-Semitism to tarnish her. assets.documentcloud.org/documents/4883…
#Manafort manipulated the media with disinformation and then used those planted news stories to manipulate US govt: "I have someone pushing it on the NY Post. Bada bing bada boom…The Jewish community will take this out on Obama on election day if he does nothing.”

The jury went out to deliberate at 9:37am. After they left, the judge addressed a motion that a coalition of media groups (including BuzzFeed) filed seeking info on jurors and to unseal various sealed docs/transcripts. Here's the motion: assets.documentcloud.org/documents/4770…
The judge granted the media's motion to intervene to argue for access, and said he'd try to hold a hearing this afternoon on the substance of the request. The judge said he plans to release sealed materials at the end of the case, with "one exception" (didn't say what that was)

1. Here is what actually happened in #ManafortTrial
Today Mueller team called expert IRS witness to stand Judge Ellis wasn’t happy because he thought (incorrectly) he’d ruled to not admit experts because that is his typical procedure.
2. Asonye reminds him that in fact this witness was cleared to stay (true) and Judge Ellis says fair enough, it might be what transcript says but wants to remind Asonye (who appears frequently in his court) that it’s not typical he also says it’s not a big deal.
3. Transcripts show that this expert witness was in fact allowed to stay, hand it to Mueller’s team for cleverly calling him an IRS agent because case agents are allowed to remain. Also fail on Manafort team for not objecting unless they have a plan🤷🏼‍♀️
