Update on Bijan Kian: Citing a significant amount of evidence to obtain from foreign countries, defense attys asked to delay trial date until September. Judge Trenga denied the request for now, saying defense must first file a motion outlining...

why they need until September & what foreign evidence they may need to require. He also told them to work "realistically but diligently" to meet the speedy trial date which is currently set for Feb 11.

For now, Trenga has asked that defense attorneys file any motion to continue by Jan 21. A hearing on that motion will be held Feb 7.

Good morning from inside the media room at the USDC Eastern District of Virginia. Bijan Kian's status conference with Judge Trenga gets underway this morning at 10AM. Story to come @CourthouseNews. Trial set for Feb, so today I'm expecting negotiating around docs/schedule etc.
Friendly reminder for those new to USDC EDVA coverage - while there is a media room, there isn't a closed circuit TV feeding the activity in the courtroom down to reporters. That means I can only update once out of the courtroom. Stay tuned.

House Dems released their rules package last night. Vote goes down this week. Here's a taste of whats inside as House Dems push for a return to "regular order":
- Bills that go thru the Rules committee must have a hearing and markup session before going to floor

- All major bill text must be available 72 hours before it can be voted on
- Training will be extended for congressional staff on how to handle whistleblowers

- State in rules that any member who has been indicted should resign
- Amend House rules to "unequivocally" ban sex/gender discrimination

One thing I'd like to say about reporting in 2018 and I speak only for myself here:
If I was a reporter in the same capacity today during the Obama administration, I would have questioned, critiqued and demanded high standards as I do with Trump.

If Obama would have handled himself on Twitter as Trump does today, I would react and respond and report the same way.
I dont change my reporting based on the political party in power. And when this administration ends and another begins...

Should it be a Dem or Republican in office in 2020, if anything were to change for me it would be this: I will demand even HIGHER standards of performance from them, ask even more questions of them and expose the hypocrisies and falsehoods with greater fervor. But why?

BREAKING: The Special Counsel's Office notified a Federal Court In Virginia that they will seek immunity for up to 5 people to testify under conditions of immunity in the upcoming trial against Paul Manafort

(These people have not been publicly named before in the case.)
"The Special Counsel's Office says they aren't sure if they will call any of the witnesses so they want to file the requests for immunity under seal."
A salient point to be sure. Immunized witnesses for Manafort's trial might simply be there to lay a foundation to prove that Manafort's actions now correspond to his prior bad acts to indicate a pattern of behavior. The other options are tantalizing though

Price gets Wagner to say that the prior jury found infringement, but never decided what constitutes an article of manufacture. Wagner also says it took him time to get data from Samsung because the data is highly confidential, and there were language issues.
Wagner says Samsung pays him $795 per hour, and Apple's damages expert Julie Davis charges $900 per hour. Wagner testified yesterday that he has worked over 8,000 hours on the case since 2011. So he's made about **$6.36 million** by my tally.
The parties finished with Wagner, and both parties have rested their case. Judge Koh says she needs some time to finalize jury instructions, so she let the jurors take a 15-minute break.

1/ This court case is a very unusual action brought by Michael Cohen. He asked for two things—a temporary restraining order and a preliminary injunction. It is highly unusual for someone to seek either of those things to stop to prosecution from reviewing seized evidence.
2/ A temporary restraining order is a short-term action by a court to prevent *immediate* harm that can’t be repaired. For example, if the government is about to bulldoze your house, you might seek a TRO because you can’t undo their action.
