I need to correct the first bit of the above by noting that in a 1927 decision, Biddle v Perovich, Justice Oliver Wendell Holmes, Jr. attacked and rejected Chief Justice Marshall’s reasoning in the Wilson case. Dersh isn’t dead wrong; Biddle supports him. supreme.justia.com/cases/federal/…
You may fault me for taking approx. 12 hours to recognize Biddle. However, bear in mind that the Supreme Court of Oregon kept deciding cases based on Wilson for *86 years* after 1927 before they finally recognized Biddle. caselaw.findlaw.com/or-supreme-cou…
