1/ Some people ask - "Why can't we just have a Canada style deal or a Canada+ / SuperCanada deal with the EU?"
2/ Firstly, it won't solve the Irish border problem. We looked into it. Considered every angle.
3/ even if it did, CETA took years to agree. We leave the EU *NEXT MARCH*
4/ the Prime Minister has rejected it for good reason: gov.uk/government/spe…
5/ but you might say - well okay, CETA might not work but what about CETA+ or SuperCanada? I.e. CETA with bolt-ons? Well first, logically that would take even longer to complete. And secondly it would breach the MFN clauses in the EU's most recent FTAs.
6/ okay then - what is the answer if not SuperCanada? Answer: EFTA/EEA with a new bilateral customs deal - a bespoke British model you could say. And here is how you do it. /End

In which @DanielJHannan says (in the end) that EEA membership would be better than a customs union with the EU. Some thoughts.
1. Hannan is right to point out serious constitutional/democratic deficiencies with a CU. Essentially, the U.K. would be bound by tariffs (and trade remedies such as anti-dumping duty or responses to Trump tariffs) in which it - and Parliament - has no say.
Taxation - even taxation on imports - without representation raises democratic issues. (See Boston harbour in 1773.)

A thread on the aftermath of the Brussels Summit, and the state of UK politics. Today, I have been trying to teach the latest Brexit developments to groups of students @BristolUniLaw. It has helped me to get some perspective. 1/
Teaching tends to help me a lot. In order to be able to explain things, you have to understand them. Where there are gaps are inconsistencies in reasoning, they tend to get exposed. 2/
To Brexit then. The key for TM for now, is to reach agreement with the EU on the Irish backstop (the other parts of the WA are more or less agreed); and to get that agreement through Parliament. Then Brexit will be done. 3/

Take this for example, ditch #EU regulation and replace it in order to reach a trade deal with the US. They will have us for breakfast, forcing further deregulation and acceptance of harmful agri-products. Industry don’t necessarily want it and in services they will squeeze us./2
This; how, what and when? @DavidDavisMP has been Secretary of State for 2 years and hasn’t come up with any substantial and viable proposals, as the technology doesn’t exist. Neither has he strongly engaged with the #EU27 to work this out due to lack of internal HMG agreement. /3

Recap of debate in House of Lords y'day on Amendment 25 re: Irish #border in EU Withdrawal Bill #Brexit
HoL had tabled an amendment specifying no checks & controls of any sort. Pared-back version offered by govt in compromise was passed.

Lord Duncan said govt accepted thrust of amendment but made 3 changes to ensure it's 'fit for the statute book':
- to reflect fact W'drawal Agmt =btn UK & EU not IRL
- to refer to '98 NI Act re: N/S cooperation
- tighten wording (but said still inc. range of checks/controls)

5 Lords spoke. Lord Cormack welcomed ‘real meeting of minds’ in this instance. Lord Murphy reported from BIIPA ‘unanimous agmt that Brexit is dominating British-Irish rels’
& noted ‘there is no political voice from NI in the negotiations dealing with these important issues.’

1) Theresa May’s proposal to apply the Northern Irish backstop to the whole UK will be rejected.
2) the backstop is cherrypicking parts of the single market - the EU accepted it because of the unique circumstances of NI. It is NOT acceptfor the whole UK
3) Moreover, there is no way a decision on Customs Union can go into the Withdrawal Agreement. It can only be agreed under future relationship - important point of procedure
