Eric's absolutely right. But there comes a point in the life of a ruling class when it can no longer make the best decisions for itself. It's so pushed up against a wall that it can't see beyond the wall. B/c there is no beyond. The GOP may be reaching that point.
I suspect for the GOP, this is pretty existential. They know their only future is the courts; they're terrified if they pull this one, there may not be another one. I remember John Gray telling me about this 20 years ago. How Thatcher had a sense of suppleness/flexibility that
only movements in their ascendancy and peak have, where they're so confident of their power that they can make tactical retreats without it feeling like a retreat. I just don't think the GOP is any longer like that.
