New from me: Two FOIA lawsuits have detected a significant trove of unseen documents from Kavanaugh's time at the White House that relate to the Senate hacking scandal and other controversial subjects. yahoo.com/news/lawsuits-…
Of particular interest are a handful of emails sent by Manny Miranda to Brett Kavanaugh in December 2003, after Kavanaugh had moved from the counsel's office to staff secretary, which Democratic Senators confirm include the word "Lundell"--the surname of Miranda's co-conspirator.
The Senate hacking scandal broke in the press in December 2003 after excerpts from Democrats' proprietary documents, stolen by Miranda and Lundell, began to appear in conservative opinion columns.
Regarding the senate hacking scandal, the FOIA lawsuit filed by Democratic Senators discerned approx responsive 3500 Kavanaugh records. The Senate judiciary committee has received only 1721 records from the disclosure process managed by President George W. Bush's private lawyers.
On other privacy-related subjects, a FOIA lawsuit filed by the privacy group EPIC is proceeding in stages. As a first step, NARA agreed to give EPIC tabulations of records that have already been noticed for release to the public and are under final review by Bush and Trump.
The NARA tabulations of this subset of responsive records substantially exceed the total number of records available to the judiciary committee, according to Democratic aides.
I wrote in the story it's unlikely this changes any votes tomorrow. What is likely, not just because of these lawsuits but because of the whole process McConnell and Grassley designed, is that much more primary source information about Kavanaugh will become public after tomorrow.
NARA is working to make a lot of documents Grassley requested public. In a couple years, Bush era records--including from the unrequested staff secretary years--will start to become public. That will all happen while Kavanaugh, barring a surprise tmrw, sits on the bench for life.
Just today, Senator Blumenthal and his colleagues negotiated with the National Archives for more information about the handful of December 2003 emails from Manny Miranda to Kavanaugh, confirming that they include Jason Lundell's last name, per a Dem aide. documentcloud.org/documents/4956…

The existence of this unseen and unevaluated evidence is important to keep in mind while Republican senators tweet about doing their "due diligence" this evening.
