That Roberts has not referred the cases for investigation has caused concern in the legal community. If Kavanaugh is confirmed, the misconduct complaints against him may not become public and instead will be dismissed.

Bush 43 appointed-Roberts, who has yet to refer misconduct claims against Kavanaugh for investigation, has for many years hired Kavanaugh clerks to work for him. Bush credits Kavanaugh with helping him choose Roberts for SCOTUS when Kavanaugh was a White House lawyer.
