If I am right, then #SCITUS will beat a retreat from the redistricting war but felling the “independent redistricting conmissions” as it goes because the Constitution is clear on the role of the state legislatures, and there is no warrant for #SCOTUS to undo the Constitution here
save in cases where it conflicts with 14th Amendment guarantees on racial equality. As my Post column argues, the Court has spent decades making easy Con Law cases hard. @rickhasen and disagree on be wisdom of what’s coming but agree on the result.
