MORE SCOTUS NEWS: CJ Roberts joins liberals in DENYING a Trump administration's request to stay lower-court ruling against his asylum ban. Justices Thomas, Alito, Gorsuch and Kavanaugh dissent.
If/when this comes to SCOTUS for full review, Roberts is anything but a sure vote to line up against the administration again. Given his uber-deferential opinion in Trump v Hawaii (the travel-ban case) last June, he's quite unlikely to halt an asylum ban on the merits.

At my request, the researchers ran the data to try to predict the outcome of two of last year's big cases (on gay-wedding cakes and gerrymandering) by listening closely to Justice Kennedy's pitch. (Results weren't great.)

Signs in the SCOTUS orders list this morning of the new conservative majority's strategy: go after agencies' leeway in interpreting their own regulations (a @FedSoc priority), but steer clear (for now) of abortion-related controversies.
The Court denied Gee v. Planned Parenthood & Andersen v. Planned Parenthood (PP funding challenges) and granted Kisor v. Wilkie (challenge to Auer deference) supremecourt.gov/orders/courtor…
The strategy is anchored by Roberts & Kavanaugh: either justice could have been the tipping-point vote to grant the Planned Parenthood cases.

JUST IN: In the wake of last night's ruling by Judge Tigar extending his TRO against the asylum ban into a preliminary injunction, DOJ asks #SCOTUS to treat their prior and still-pending stay request, which was regarding the TRO, as being about the new preliminary injunction.

What that means is that DOJ had been asking the Supreme Court to allow it to enforce the ban — see my story here: buzzfeednews.com/article/chrisg… — and now, in light of this new ruling, DOJ is asking the justices to let them keep their request pending based on the new ruling.

IN TODAY: We have new circuit allotments for the justices: Sotomayor adds the 6th (to the 10th, which she already had), Kavanaugh has the 7th, Kagan has the 9th. (The Chief had taken on the 9th since Kennedy's retirement, and Kagan previously had the 6th and 7th.) #SCOTUS
The main reason, now, why the circuit allotments matter is that the justice assigned to a circuit receives applications in cases out of that circuit, mainly attempts to stay lower court rulings pending further appeals and requests for stays of execution.
Justices almost always refer full consideration of substantive decisions on applications to the full court. There have been a few exceptions in recent years, but mainly when it was a recurring matter and the outcome was pretty clear/likely.
