1. Transit upload (theft) again! Shorter this time.
2. People keep saying the Province can upload the subway and we can't stop them. This is not true. I say that because we use the word "can" in a loose way. There is a distinction between "can' - has the necessary ability - and "may" - has the necessary permission.
3. Of course they may upload the subway, I don't believe for a second that they can. Even if they pass a law there remain hundreds of legal and technical hurdles to clear.
4. For the subway system to work it has to fit with: our electrical system, our water system, our sewer system, labour law, property law, the surface transit system, emergency preparedness, sidewalks, roads, planning, expropriation law, air quality law, ...
5. ... our police service, Duty of Care jurisprudence, noise bylaws, civil law as it relates to neighbouring property, tendering law and practice, and many more. In fact, I look forward to responses which add to this list.
6. The Province "may" stomp around and say they are in charge. The Province "can't" handle all the above. They haven't the staff or experience. We do. We are literally the only people in Ontario who "can" handle all of this as it relates to running and building a subway system.
7. Given that they "may" but they "can't", we hold all kinds of cards. Let's not roll over. - end.
