There's a reason even Bush and Cheney were not prosecuted for war crimes and rights abuses they clearly committed. The slippery slope is far too seductive. Imagine if that precedent had been in place; Trump would already have Obama and the Clintons in prison on nonsense charges.
We have a vital history of NOT prosecuting former political leaders. Nixon was not charged, and neither was Reagan. Such prosecutions can too easily become frivolous.
But all this has emboldened Trump and his evil advisers, who think because of that history, he's above the law.

That tradition will have to change--Trump MUST be prosecuted--but it has to change in a way that doesn't encourage future presidents to jail previous ones on a whim.

Such a Commission may be the only way to repair America when this is over. The traitor in the White House and his dozens (hundreds?) of enablers at all levels of government have to be removed and punished to send the message that America is still a nation of laws.
