Today, we are heading to the US Court of Appeals for the 5th Circuit arguments in our Stringer v. Whitley case. This is our "motor voter" case against Texas for failing to comply with the federal National Voter Registration Act. We sued in 2016. nbcnews.com/news/us-news/t…
Because of Texas' failure to comply with the law, at least 1.5 million people are not receiving an opportunity to register to vote as required by federal law. Under the NVRA, eligible voters have a right to register to vote every time they update or renew their driver’s license.
Our clients attempted to update their driver’s licenses and voter registration records through the Department of Public Safety website but the state disregarded their registration request. When they tried to vote, they were not allowed to cast a regular ballot.
In April 4, 2018, Chief Judge Orlando Garcia ruled that Texas violated the law. and ordered the state to comply with a 45-day deadline to update the online system so that individuals who use the system are able to register to vote. texastribune.org/2018/04/03/fed…
Unfortunately, the state of Texas requested that the 5th Circuit stay the case and remedy. The 5th Circuit stayed the case on May 31, 2018, paving the way for the hearing in New Orleans today. texastribune.org/2018/05/21/jud…
