At the 5th Circuit, in the appeal of the case where a district judge declared the ACA to be unconstitutional, the court GRANTED the House's intervention on appeal to defend the ACA and DENIED the ACA-supporting states' motion to expedite the appeal.
Neither of these rulings is particularly surprising, to be clear. Just noting them!
In plain English: House Dems will be able to argue in support of the ACA at the appeals court, and the appeal at the 5th Circuit will proceed at a normal pace. (Recall that the trial court ruling is on hold pending appeal, so nothing has changed yet.)
