Client was 19 y/o now 20. Working at La Nortena Restaurant as a delivery driver using the restaurant’s motorized scooter. His boss sent him to the grocery store to pick up shrimp, onions & avocados. Here he is parking the scooter & walking inside. Minutes before assault.
Seconds after he walks into grocery store, he’s followed in by a plain clothed officer. Wearing a “Don’t tread on me” shirt. Outside, a group of officers gather.
A female officer walks over to the bike. Also in plain clothes. Officers later claimed they thought (assumed) the scooter was stolen. She was checking the bike for registration while the 2 massive male officers waited for the client to leave the store.
A store employee comes in after seeing who he thinks is some random person messing w/ his bike. Store knows client from coming for groceries from La Nortena. Employee says “Someone is outside messing w/ your bike.” He puts groceries down. Walks out. Doesn't realize what’s next.
The assault. Walks w/ officers. Cooperates. Then they begin on him. Throw him down. Slam his head multiple times into the concrete. Taze him. He’s never been arrested before. He’s terrified. They charge him w/ resisting arrest & disorderly conduct for causing a crowd to gather.
He didn’t cause any one to gather. The brazen police violence was impossible to look away from.
Store employee who was worried about his bike is visibly upset. Can’t believe what the officers are doing. Dozens of others are watching him getting pummeled. Some are taking video.
After they pull him up by his back-cuffed arms & lead him away, they take his keys & his bike. They put additional charges on him: Riding a motorized scooter. Reckless endangerment (for driving they didn’t even see). Also charge driving w/ no helmet. Dont see officer wearing one.
My colleague & our investigators have tried finding witnesses to no avail. Met w/ client last week. He’s clearly still traumatized by his first ever interaction with the police. Didn’t want to see video. But wanted me to share it. “Hopefully it’ll help.” Again—tips: info@bds.org.
