Let me try to summarise the problem in five tweets or less: 1) legally the ref was advisory only but 2) that’s not true de facto (thread)
De facto public sentiment has shifted from representative and direct democracy. Expressions by the demos are seen as more legitimate and important than expressions by its representatives.
This creates a problem for the British constitution. Parliament is sovereign, but defers to the referendum. So what did the ref say and how long is it valid?
We have no procedures to authoritatively state one or the other. Instead, representatives invoke the ref result to endow their particular aspirations with the higher status of ‘the will of the population’
