NEW: DOJ confirms AG Barr will not show up tomorrow for a hearing before the House Judiciary Comm.

"Congress and the Executive branch are co-equal branches of government, and each have a constitutional obligation to respect and accommodate one another’s legitimate interests."
DOJ objected to the committee's plan to have staff attorneys question the AG in addition to members.

DOJ spox: "Chairman Nadler placed conditions on the House Judiciary Committee hearing that are unprecedented and unnecessary. "

NEW: DOJ has released a new opinion from the Office of Legal Counsel saying former White House counsel Don McGahn is not legally required to testify before Congress (deleted prev. tweet that didn't specify he's a *former* WH counsel) assets.documentcloud.org/documents/6018…
McGahn, who featured prominently in the obstruction section of Mueller's report, was subpoenaed to testify before House Judiciary. Steven Engel, head of OLC, wrote that Congress cannot "constitutionally compel" top White House advisers to testify about official duties
Engel writes that because McGahn is shielded by immunity and the president can order him not to testify, McGahn can't be held civilly or criminally liable for following that directive (aka he can't be held in contempt)

Notwithstanding Manning's pledge not to cooperate with this or any grand jury, the judge said he believed there was still a chance that more jail time could prove coercive. "It's unfortunate we're at this point," US District Judge Anthony Trenga said buzzfeednews.com/article/zoetil…
The judge also imposed a fine — after Manning spends 30 days in jail, a $500/day fine will kick in, and that amount will go up to $1,000/day after 60 days. The prosecutor didn't push for a fine, saying Manning could just go on social media and fundraise buzzfeednews.com/article/zoetil…

SCOTUS is the top court in the land, full of justices with lifetime tenure. They are the final stop when it comes to interpreting federal law. It’s heady, the importance and power they have.
But wait. They are one of the co-equal branches of government. That means there are checks and balances for them, too. Alexander Hamilton famously said they were the weakest of the branches.
