The starting point is to identify legal failures by the returning officer.

Even this stage of the exercise is likely to be difficult because the returning officer is very likely to have an audit trail justifying their decisions to post on date x or use service y. /1
But it gets worse still. Even if you are able to identify legal failures you then have to show an effect on the outcome of the election for the election to be voided and re-run. /2
This is likely to be very challenging in evidential terms. We are unlikely to have before us material that substantiates claims of systemic (as opposed to individual) failures. /3
We are also advised there is no meaningful remedy for being disenfranchised. If, having done everything right, you are still unable to exercise your legal right to vote, that is something you may just have to bear. /4
All one can do is look at the results of the European Elections after the event and identify narrow losses and seek to determine whether it is possible sensibly to construct an argument that the result was effected by mass disenfranchisements. /5
It is a matter of profound regret to us that this fails to create hard-edged incentives for returning officers to maximise their efforts to secure that everyone is able to vote. However, this is the advice we have received. /6
