1/ In Flowers v. MS, Gorsuch joined Parts I, II, and III of Thomas's dissent. For sure, Gorsuch did not join Part IV of the dissent. But did he join the three-page introductory section, and the one-graf conclusion after the *? @dorfonlaw said No. dorfonlaw.org/2019/06/wrap-u… #SCOTUS
2/ The closest example is Thomas's dissent in Grutter. It had 7 parts, and Scalia noted that he joined Parts I-VII. supreme.justia.com/cases/federal/… What did Scalia not join? The Introduction and the one-paragraph conclusion after ***--both of which talked about Frederick Douglass.
3/ Is there a notation to indicate that a Justice does not join the introductory section of an opinion (that is not numbered?). In Flood v. Kuhn. CJ Burger and Justices White "joined ... all but Part I" of J. Blackmun's lengthy homage to baseball. caselaw.findlaw.com/us-supreme-cou… #SCOTUS

1/ Running Thread on Dept. of Commerce v. NY #SCOTUS
2/ Roberts's discussion of the Enumeration Clause is, in effect, a discussion of the scope of Congress's implied powers. Taken literally, the Enumeration Clause would only allow the government to assess a headcount--it could not ask any demographics questions.
3/ What provision of the Constitution empowers Congress to ascertain information about demographics? The answer has to be the Necessary and Proper Clause. Yet, as it often does, the Court fails to cite the Necessary and Proper clause in an implied powers case.

1/ Belated thread on Gundy v. US. I plan to teach this case in class when I cover the non-delegation doctrine. The Gorsuch dissent provides a thorough overview of the doctrine from CJ Marshall to the New Deal to the present. #SCOTUS
2/ Alito's decision to concur in judgment made the vote 5-3. Had Alito went along with Gorsuch, the vote would have been 4-4, and the lower court would have been affirmed by an equally-divided margin. In such a case, Gorsuch would not have been able to write a separate opinion.
3/ Alito probably cringed at joining an opinion that would declare unconstitutional regulations that punish sex offenders. But here, he took one for the team, and in the process, signaled that he would reconsider reviving the non-delegation doctrine in an appropriate case

1/ Belated thread on Virginia House of Delegates v. Bethune-Hill, which suddenly took on new relevance in light of 5th Circuit's ACA supplemental briefing order: #SCOTUS
2/ This case concerns whether a state legislature has "standing to appeal" *after* the district court issued a ruling. The newly-elected Democratic AG "would not pursue an appeal to" #SCOTUS However, the GOP-controlled House filed a notice of appeal.
3/ #SCOTUS held that the House "lacks authority to displace VA Attorney General as representative of the State" and "single chamber of a bicameral legislature, has no standing to appeal the invalidation of the redistricting plan separately from the State of which it is a part"

Justice Alito joined the 7 member majority that reversed the decision of the Mississippi Supreme Court in Curtis Flowers’ case. But don’t get any ideas. He’s very clear that this case is “one of a kind.”

I've only ever been repped by UTA. I’ve been with them nearly 15 years. I have three agents on the TV side, one on the feature film side. They know me. They get me. We don’t hang out, but we’re friends. We respect one another and put up with each other’s eccentricities.
The WGA’s desire to reevaluate/renegotiate the AMBA isn't personal. It’s not an attack; rather, it’s self-defense. Despite profits soaring everywhere, the wages of writers have remained stagnant and in some areas (particularly cable and streaming) we’ve seen a slight decline.

That date was 7/10/2018. Given that all domains were registered through GoDaddy’s anonymous registration service, WHOIS doesn’t tell us much. But the site is copywritten to @judicialnetwork, so we know they’re involved. Let’s take a look at the page source for the .com site:
