1. Morning All. Ready for the next episode of “Know Your Epstein Non-Prosecution Agreement?” You might want to get comfortable, this is gonna take a minute: then-US Attorney (now disgraced & dismissed Labor Secretary) Alex Acosta, decided . . .
2. he would pick attorney’s for Epstein’s victims? Yes, you heard right. Per the agreement, “The United States (meaning the prosecutors) shall provide Epstein’s attorneys with a list of individuals whom it has identified as victims.” Here’s the kicker, guess who could object ...
3. to the attorneys the prosecutor selected for the victims? EPSTEIN! Hang w/ me here because NONE of this makes sense. The agreement continues, “Upon execution of this agreement, the United States, in consultation with and SUBJECT TO THE GOOD FAITH APPROVAL OF EPSTEIN’S COUNSEL-
4. (the prosecutors) shall select an attorney representative for these persons (the victims) who shall be paid for by Epstein’s Counsel. Epstein’s counsel may contact the (victims) through that representative.” So Epstein basically has veto authority over...
5. any attorney the prosecutor selects for any victim. Why is the prosecutor picking attorneys for the victims? Because the non-prosecution agreement contemplates that Epstein will - in substance - pay off the victims. The agreement continues, if any of the victims...
6. “decides to file suit (sue Epstein for what he did to them), Epstein waives his right to contest liability and also agrees to waive the right to contest damages up to an amount agreed to between (the victim) and Epstein.” This doesn’t make sense but moving on ...
7. Acosta made sure to protect Epstein by saying that nothing in the non-prosecution is an indication Epstein did ANYTHING wrong: “Epstein’s signature on this agreement (is) . . . not to be construed as an admission of civil or criminal liability.”
8. I could go on to relate more insane provisions of the non-pros agreement but I’ll stop here. What does all this mean? First, let’s recall that Acosta hid the plea agreement from the victims in violation of their rights, as a federal judge ruled in February.
9. While hiding it from the victims Acosta was deciding that he would get lawyers for the victims - and that Epstein could decide who those lawyers would be AND Epstein would pay for those lawyers. This is what we call A CONFLICT OF INTEREST! This is not how things work!
10. Acosta’s conduct is unethical not to mention arrogant, demeaning and disrespectful of the dozens of Epstein’s young sexual assault victims. Acosta is the antithesis of what a prosecutor should be. Acosta must be held accountable for this staggering misconduct. Full stop.
