A federal judge has pretty resoundingly rejected ex-Trump adviser Roger Stone's request to have the charges against him dismissed. "The defense has not identified any legal rounds that would support dismissing or enoining this action."
Stone will get to see the redacted portions of the Mueller report that relate to him.
The judge rejects Stone's argument that the sepration of powers prevents him from being charged with lying to Congress absent a congressional referral."The defendant misapprehends the fundamental allocation of authority established in the Constitution."
Sentences like this are usually not a sign that the judge is pleased with defense counsel.
The judge also rejects Stone's argument that funding Mueller's office violated the Appropriations Clause.
And the judge rejects Stone's argument that Mueller's appointment violated the Constitution's Appointments Clause. The D.C. Cir. had already rejected this theory, so the outcome here was not in doubt.
And the judge says Stone has failed to make a showing that he was selectively prosecuted for supporting Trump, so he won't get to take any discovery on that question.
Judge: Roger Stone has shown "absolutely no evidence" that he was prosecuted because of his relationship to Trump.
