1/3 Even if we acknowledge that voter registration (or refusing to register) can be expressive conduct, the state's non-speech interests in voter registration are sufficient to support automatic voter registration and overcome any First Amendment-based objection under O'Brien.
2/3 An automatic voter registration requirement has nothing to do with suppressing the content of anti-voting or anti-registration expression. Heck, the state can probably even prohibit you from setting your voter registration card on fire!
3/3 My main concern about automatic voter registration is not 1st Amd, but rather protecting the right to vote by ensuring that only eligible voters are registered - U.S. citizens w/ no disqualifications in their place of domicile - and that records are updated and accurate.
