Extra written submission on behalf of former Tory PM Sir John Major:

- Effect of prorogation "to deprive Parliament of a voice".

- Fact Government hasn't provided all the evidence is "deeply concerning".

"... Effect of prorogation is to prevent Parliament from discharging its role during a time-critical period", the result of which is that there is "no meaningful political control of that decision until after the damage has been done".
"Deeply concerning" that there is an "absence which ought to have been available but not been provided".

Dr David Nicholl responds to Commons Leader Jacob Rees-Mogg claiming that he is as irresponsible at the anti-vaccine campaigner Dr Andrew Wakefield.

“I am speechless. I challenge him to repeat that outside the Commons and if he does I will sue him.”
“This is an attempt by a Government minister to bully a whistleblower,” Dr Nicholl adds.

“Forget Brexit for a moment, this cuts to the core of whether the Government is willing to listen to experts. Yes or no.”
Dr Nicholl adds: “I need to call him out. The best way to treat is a bully is to call them out.

“If he has got a problem with my probity he can refer me to the GMC. I am particularly offended by the comparison to Andrew Wakefield.”

Questions being asked about how Labour can vote for a General Election tomorrow and stop a No Deal Brexit.

It looks like it can be done because of clever drafting of this afternoon’s motion to take control of the parliamentary timetable.

As per @cgwOMT recent tweet, this afternoon’s motion - if passed - will prevent the Government from proroguing Parliament this week because it takes control of NI Executive Act and prevents a debate on the act before Monday.
The NI legislation was passed before the summer recess to prevent prorogation of Parliament until MPs had been given an update on progress to restore the power sharing agreement.

That’s down for Monday.

And today’s motion means that update cannot be provided before Monday.

Dr David Nicholl, consultant neurologist who took part in drafting Operation Yellowhammer, rings in to ask JRM what level of mortality rate he would be willing to accept in the event of a No Deal Brexit.
JRM says a doctor in his position should not be "fearmongering".

"I don't think there is any reason to suppose a No Deal Brexit should lead to (an increase) in the mortality rate.

"This is the worst excess of Project Fear."
Dr Nicholl: "Can I remind you I wrote the plans in mitigation?"

JRM: "Well, you didn't write very good plans if you hadn't worked out how to mitigate, had you?

"It's fortunate that they're being written by other people now who are serious about mitigating and not remoaners."

Wolffe's case is that judicial review operates on a "sliding scale" with greater intensity when constitutional principles are at stake. The court must give it a "rigorous and searching review."

Judge Carnwath says he's a critic of concept of sliding scales.
The government's case is separation of powers between court and parliament.

Wollfe says separation of powers is "predicated on accountability of government to parliament". Court must grip what happens if this is removed.

THREAD I have been wading through the full judgment from Scotland's highest civil court, the Court of Session, on the prorogation of parliament this evening (with assistance, as you can see). Here are some points I think are interesting. #Prorogation #TheNine
First, what is this all about? A group of parliamentarians led by @joannaccherry of the SNP wanted to stop the prorogation (suspension) of parliament, which has now taken effect, arguing that it was unlawfully designed to stymie parliamentary debate on Brexit.
As it happened the High Court in London has rejected a similar case but one argument made by the petitioners in Edinburgh (that is, Ms Cherry and co) was that Scotland (which has its own legal system pre-dating the 1707 union with England) had different law in this matter.

Ok new thread to keep things clean. Lord Pannick is explaining that Gina Miller's legal challenge is focused in on why the PM needs to close Parliament for five weeks ahead of a Queen's Speech - longest for 40 years - just as the Brexit clock ticktocks towards midnight.
He asks: Is the five-week closure reasonable to meet the objective - which is to close a Parliamentary session ahead of a Queen's Speech. "It is not manifestly necessary to have a five-week prorogation," he says.
"It is not merely that it is a prorogation of an exceptional length at a critical time & that the PM can provide no reasonable basis for needing it. This case involves a decision by the PM that is *fatally infected* by the PM's failure to understand that Parliament is sovereign."

Major carefully and precisely lists his genuine concerns. And then the last graph: “Later in the programme, the former Brexit minister Suella Braverman, who resigned from government in protest at May’s deal, dismissed Major’s comments, describing them as ‘remainer elite views.’”3

This was a hugely significant intervention from the Brixton-born former PM Sir John Major. Utterly damning of this government and its Brexit strategy. The people have every right to have a vote on the Brexit deal. 1/
As John Major said, the vote in 2016 gave the government a mandate to begin negotiations, but "not any Brexit; not at all costs; and certainly not on any terms." 2/
The government's red lines are severely restricting our ability to obtain an outcome that is not damaging to business, jobs, and our rights at work. We should be keeping all options open during these negotiations. 3/
